Terms & Conditions
These terms and conditions are made by Rowse Farm Holiday Cottages and the Customer who books their holiday with us.
General
The rental period is for a maximum of four weeks and starts at 4.00pm on the first day of the booked holiday and ends at 09.30am on the last day of the booked holiday.
Weekly changeover days are normally Friday but we can be flexible. Check-in is between 4-6pm and checkout is 9:30am on the day of departure. Later check-in times can be accommodated if due to travel disruption, scheduling or delays.
Bed linen and towels (except sports and beach) are provided.
We can provide a cot (except bedding) & highchair free of charge. This must be booked in advance as availability is not guaranteed.
We can offer short breaks, subject to availability, at the following basic rates:
Minimum price short break is based on 4 nights stay in Tikkidew and Skyber Cottages and 3 nights in Kellywyk Cottage.
Rates are calculated as a percentage of the weekly rate;
3 nights = 60% of weekly rate for midweek, 65% for weekend;
4 nights = 64% of weekly rate;
5 nights = 80% of weekly rate;
6 nights = 96% of weekly rate.
Weekly (non Fri) arrivals are charged on the highest rate in the booking period.
Christmas and New Year breaks for all cottages are based on a minimum 4 night stay.
Booking
The Customer who completes the Booking Form agrees that:
– they are authorised to accept these Conditions on behalf of the Guests associated with their booking, including those substituted or added after the Booking Confirmation is issued
– they acknowledge that Rowse Farm Holiday Cottages essentially provide family holidays and it is our policy not to accept bookings for hen or stag parties or from groups of people under the age of 18 years.
Bookings made through the online system/website are provisional until confirmed by Rowse Farm Cottages.
Payment
Unless otherwise agreed in writing by Rowse Farm Holiday Cottages, the Rental Fees are as stated on our website at the time of submitting the Booking Form.
If a booking is made four or more weeks before the first day of the booked holiday, a deposit of 25% of the cost of the holiday is payable to secure the dates.
Payment balance of the rental fees and additional charges are due to Rowse Farm Holiday Cottages four weeks before the first day of the booked holiday (The Due Date) and this will be detailed on the Booking Confirmation
If the balance of rental fees is not paid by the Customer on the Due Date, then the Customer will be deemed to have cancelled their booking and Rowse Farm Holiday Cottages shall retain the Booking Deposit.
If a booking is made less than four weeks before the first day of the booked holiday then the full rental fee, plus any additional charges (such as charges for pets) is payable.
Payment methods
Method of payment All payments made to Rowse Farm Holiday Cottages may be made by cheque or electronic bank transfer. Cheques should be made payable to ‘Rowse Farm Holiday Cottages’ and can only be accepted if received at least two weeks before the Start Date. Post-dated cheques are not acceptable.
Overseas Customers are required to pay in Pounds Sterling by cheque drawn on a UK bank or by international electronic transfer. Any charges for payments from overseas will be passed on to the Customer.
Changing a booking
The rental period may not be changed by the Customer once full payment has been made, unless approved and confirmed in writing by Rowse Farm Holiday Cottages.
Cancellation
Our cancellation policy is under regular review, and aims to be as fair as possible with regards to your risks of unforeseen guest cancellations, whilst protecting our business.
If a Customer wishes to cancel the booking, they must notify us in writing. Non-availability of Property (defined later in this document) shall apply if the Property is unavailable due to an event outside the control of Rowse Farm Holiday Cottages
In the event that a Cancellation Notice is received by Rowse Farm Holiday Cottages, a cancellation charge is payable depending on the number of days before the Start Date. The amount payable is set out below:
0 – 13 days 100% of full booking fee
14 – 27 days 60% of full booking fee
28 days or more and booking payment made will be refunded.
Rowse Farm Holiday Cottages strongly recommends that Customers take out cancellation insurance in relation to their booking
Booking Conditions
As part of the booking, the Customer agrees:
- to pay for all additional utilities and fuel incurred during the Rental Period and not included in the Rental Fees;
- to report to Rowse Farm Holiday Cottages any damage or breakages affecting the Property as soon as it comes to the attention of the Customer and in enough time so that issues can be put right before the arrival of the next guests. We reserve the right to charge for any losses or damages to the Property caused by the Customer or their party.
- to take good care of the Property and leave it in a clean and tidy condition at the end of their holiday.
- to permit Rowse Farm Holiday Cottages reasonable access to the Property at all times, when requested;
- to ensure that only the Guests who are identified on the Booking Confirmation occupy the Property. The Customer further agrees that a cot may only be occupied by a child aged 24 months or less at the Start Date;
- not to smoke, use e-cigarettes, vapes, or any other smoking or vaping devices at the Property or cause an annoyance or become a nuisance to occupants of adjoining premises;
- to only use the designated parking spaces allocated (one per cottage). Unless otherwise stated, all parking spaces shall only accommodate an average sized car (e.g. a family hatchback). Additional parking can be provided but only if agreed in advance. Rowse Farm Holiday Cottages accept no liability if the Customer or Guest’s vehicle is damaged;
- to not charge the Customer or Guest’s electric or hybrid vehicle, or e-bike, at the Property. The Customer further agrees that they will not use a household electrical socket to charge an electric or hybrid vehicle as this may cause safety risks and damage to the Property;
- to ensure that any third party service providers (e.g. caterers and private chefs) have taken out insurance policies to cover all risks associated with the services they are providing;
- not to use or light candles within the Property to familiarise themselves with the fire risk assessments within the guest information folder in the Property
Property descriptions
Some of the information on the Website relates to shops, amenities and public houses in the surrounding area. Closure of such premises and other changes to external facilities are outside Rowse Farm Holiday Cottages’ control. If Rowse Farm Holiday Cottages are aware of any material changes at the time of the Customer’s booking, then it shall endeavour to inform the Customer of these changes. However, this information is provided for general information purposes and is not intended to amount to advice on which the Customer and Guests should rely. Although Rowse Farm Holiday Cottages make reasonable efforts to ensure the information on the Website is up to date, it makes no representations, warranties or guarantees, whether express or implied, that the content on the Website is accurate, complete or up to date.
Accessibility. Although we have done our best to facilitate easy access, our cottages were built in a traditional style. If you have any concerns or questions about access, please contact us before booking and we will be happy to discuss any concerns with you.
The Properties offer Broadband Internet connectivity to enable online streaming services and Wifi. The quality and provision of this service is subject to availability and network conditions.
Dogs
A medium/small sized pet dog is permitted per Property with the prior written consent of Rowse Farm Holiday Cottages. If dogs are permitted, the Customer agrees that they are kept under control, on leads and exercised away from the Property.
Dogs are not permitted in the bedrooms or on the furniture in the Property and Rowse Farm Holiday Cottages can not accept responsibility for their safety. Dogs must not be left in the Property unsupervised as this can result in considerable damage to the Property and distress to the pet. A charge will be made for each dog and will be set out on the Booking Form.
Rowse Farm Holiday Cottages welcomes assistance dogs, but this must be brought to their attention so that they can verify whether the Property can accommodate the size of dog before issuing the Booking Confirmation.
Non-availability of Property
Rowse Farm Holiday Cottages will not be liable or responsible for any failure to perform, or delay in performance of, any of their obligations in these Conditions that is caused by an Event Outside Control.
If an Event Outside Control takes place that affects the availability of the Property during the Rental Period, the Customer will be contacted as soon as reasonably possible and the Rowse Farm Holiday Cottages’ obligations under these Conditions will be suspended and the time for performance will be extended for the duration of the Event Outside Control. Where the Event Outside Control results in the Property becoming unavailable during the Rental Period, the Customer may end the contract and all payments will be refunded.
Rowse Farm Holiday Cottages only lets the Property for domestic and private use. If the Customer, or a Guest, uses the Property for any commercial or business purpose Rowse Farm Holiday Cottages will have no liability for any loss of profit, loss of business, business interruption, or loss of business opportunity.
Complaints
All complaints must be notified to Rowse Farm Holiday Cottages as soon as reasonably practicable, as Rowse Farm Holiday Cottages may be required to carry out an on-the-spot investigation of the Property and if necessary, take remedial action. All Customers have a legal obligation to mitigate their losses.
The Customer agrees that Rowse Farm Holiday Cottages shall be given the opportunity of investigating the complaint within a reasonable time and the opportunity to correct issues during or after the rental period.
Rowse Farm Holiday Cottages cannot accept responsibility for any legislation relating to dogs not being permitted on beaches or tourist areas.
Breach of contract
If there is a substantial breach of any of these Conditions by the Customer or any Guests including a breach of clauses 12.11 and 12.12, the Rowse Farm Holiday Cottages or Rowse Farm Holiday Cottages reserve the right to re-enter the Property and terminate (i.e. bring to an end) the contract that exists in relation to the Property and may recover possession of the Property.
If there is a substantial breach of any of these Conditions by Rowse Farm Holiday Cottages, then the Customer has the right to terminate (i.e. bring to an end) the contract that exists in relation to the Property and may leave the Property.
Ending the contract by either Rowse Farm Holiday Cottages or the Customer does not affect that party’s other rights and remedies.
Personal Data
Rowse Farm Holiday Cottages shall collect the names (first names and surnames), addresses (“Contact Data”). We will process the Contact Data to verify the identity of the Customer and their party who will be occupying the Property; and to contact the Customer and Guests by Email with information about the Rowse Farm Holiday Cottages’s Property.
The legal basis for processing the Contact Data is the performance of a contract and Rowse Farm Holiday Cottages’s legitimate interests.
Rowse Farm Holiday Cottages may pass this personal information to other third party service providers (acting as Rowse Farm Holiday Cottages’s agent) for the purpose of completing the booking and supplying the Property to the Customer
Rowse Farm Holiday Cottages also obtain the Customer’s personal information in the course of the sale, or negotiations for the sale, to the Customer. Rowse Farm Holiday Cottages may contact the Customer by electronic means (email & text) with relevant information and offers. If the Customer does not want Rowse Farm Holiday Cottages to use its personal information in this way, it can opt out at any time by contacting Rowse Farm Holiday Cottages or by using the links provided in the email.
Rowse Farm Holiday Cottages may retain the Customer’s information for the period necessary to fulfil the purposes for which it was first collected unless a longer retention period is required or permitted by law.
Priority
If there is any ambiguity or inconsistency in or between these Conditions and the information on the Website, these Conditions shall prevail.
These Conditions replace and supersede all previous websites and Conditions.
In the event that a court finds that a condition (or part of a condition) in these Conditions is invalid, unenforceable or illegal, the other conditions shall remain in force.
The Rowse Farm Holiday Cottages and Customer do not intend that the contract between them should be enforceable by any person solely by virtue of the Contracts (Rights of Third Parties) Act 1999.
The contract between the Rowse Farm Holiday Cottages and the Customer shall be governed by the laws of England and Wales. Each party irrevocably agrees that the courts of England and Wales shall have the exclusive jurisdiction to settle any dispute of claim arising out of or in connection with the contract or its subject matter or formation (including non-contractual disputes or claims).
